AnimAnimus Construction – Terms & Conditions

Welcome to AnimAnimus Construction! These Terms and Conditions (“Terms”) govern your use of our website and all services provided by us (collectively, the “Service”). By accessing or using our Service, you agree to these Terms. If you do not agree, please do not use our services.

1. Definitions

1.1 The Company / We / Us – AnimAnimus Construction, registered at [Your Legal Company Name & Address].
1.2 Client – the individual or organisation requesting services from AnimAnimus Construction.
1.3 Operative / Specialist / Tradesperson – any person carrying out work on behalf of AnimAnimus Construction.
1.4 Service – all work provided by AnimAnimus Construction, including kitchen and bathroom refurbishment, tiling, and plumbing.
1.5 Client’s Address – the location where services are to be performed.
1.6 Force Majeure – events beyond the Company’s control, including natural disasters, extreme weather, equipment failure, or staff illness.
1.7 Reasonable Time – time required to complete a task or respond to notifications; generally 3–5 working days for communication, or up to twice the quoted timeframe for project completion.
1.8 Additional Work – any work outside the agreed quotation.

2. Contract Formation

2.1 By accepting a quotation or booking services with us, you enter into a binding contract under these Terms.
2.2 Both parties agree to comply with all applicable laws and regulations while fulfilling their obligations.
2.3 Acceptance of a quotation via email, phone, or website constitutes full agreement to these Terms.
2.4 To secure a project date, a deposit of 30% of the total project value must be paid. The deposit confirms the booking in our calendar.
2.5 These Terms prevail over any Client-supplied terms unless explicitly agreed in writing by a Company director.
2.6 No changes to these Terms are valid unless approved in writing by a Company director.

3. Quotations & Scope of Work

3.1 Quotations are based on information provided by the Client and on-site assessments.
3.2 Timeframes and costs are estimates; unforeseen issues or additional work may require adjustments.
3.3 Discrepancies in measurements or requirements discovered during the project will be discussed, and the quotation may be updated accordingly.
3.4 All quotations exclude preparatory work, plumbing, electrical, or other specialist work unless specified. The Client is responsible for arranging such work prior to service.
3.5 AnimAnimus Construction may take photos or videos for documentation, marketing, or legal purposes. These will comply with UK GDPR and Data Protection Act 2018.

4. Client Responsibilities & Site Conditions

4.1 The Client must provide access to utilities (water, electricity) and ensure safe, clear working areas.
4.2 All fragile or valuable items must be secured or removed.
4.3 The Client is responsible for moving any obstacles not agreed to be moved by our operatives. The Company is not liable for damage caused when moving such items safely.
4.4 Other trades working on-site must not interfere with AnimAnimus Construction operatives.
4.5 The Client is responsible for ensuring adequate lighting, ventilation, and environmental conditions suitable for work to proceed safely.
4.6 Any pets must be secured away from the work area.

5. Payments & Deposits

5.1 Payment is due upon completion unless otherwise agreed.
5.2 Accepted methods: cash, cheque, bank transfer, debit/credit card.
5.3 Late payments may incur interest at 2% per annum above the Bank of England base rate.
5.4 A deposit may be required before work begins. Deposits are non-refundable once operatives have arrived on-site.
5.5 Materials and supplies required for the project are invoiced at booking; unused materials remain the Client’s property.
5.6 Additional charges may apply for transport, parking, collection of keys or materials, or work required due to unanticipated site conditions or hazards.

6. Cancellations & Rescheduling

6.1 Clients may cancel the scheduled service; less than 7 working days’ notice will render the project deposit non-refundable.
6.2 Rescheduling a project will incur a £600 amendment fee.
6.3 Call-out fees of £600 apply if operatives cannot start work due to client-controlled obstacles.
6.4 Abusive or unsafe behaviour towards operatives may result in project cancellation.
6.5 Cancellation or rescheduling due to unforeseen circumstances (weather, Force Majeure) may result in adjusted timelines.

7. Liability & Insurance

7.1 AnimAnimus Construction holds Public Liability and Employer’s Liability insurance.
7.2 We are not liable for delays or damages caused by events beyond our control (Force Majeure).
7.3 The Company is not responsible for pre-existing damage, wear, or inadequate client preparation.
7.4 The Company takes care to avoid damage to property but is not liable for minor incidental damage, e.g., paint chips, vibration marks, or existing fixtures.
7.5 Clients are responsible for any damage or hazards arising from undisclosed issues, including concealed pipes, wiring, or structural defects.

8. Service Guarantee

8.1 We stand by the quality of our work. If you raise a complaint, we will inspect and, where appropriate, repair or redo the work at no additional cost.
8.2 Guarantee Periods:

  • Kitchen & bathroom refurbishment: 12 months for labour and materials.
  • Tiling & plumbing work: 6 months for labour and materials.
    8.3 The guarantee does not cover damage caused by third parties, misuse after completion, moisture/leaks/structural issues not disclosed, or additional work requested without written approval.
    8.4 Our Service Guarantee requires full payment of invoices for work completed.
    8.5 The guarantee applies only to work carried out by AnimAnimus Construction operatives.

9. Complaints & Claims

9.1 Complaints must be submitted in writing within 7 days of service or 3 days of discovering property damage (maximum 6 months after completion).
9.2 AnimAnimus Construction will investigate complaints and aim to resolve issues promptly.
9.3 Third-party quotes for repair work must be reasonable and disclosed to us.
9.4 Mediation or Alternative Dispute Resolution is encouraged before any court action.

10. Data & Media

10.1 Photos or videos taken during service may be used for marketing, legal purposes, or documentation.
10.2 All data is stored and processed according to UK GDPR and Data Protection Act 2018.
10.3 Phone calls may be recorded for quality assurance and dispute resolution.

11. Optional / Additional Charges & Hazards

11.1 Extra charges may apply if site conditions require additional preparation, access or parking fees, or other trades create hazards.
11.2 AnimAnimus Construction reserves the right to suspend work if safety cannot be ensured.
